Description: UN Resolution #180: Fair Sentencing Act (Category: The Furtherment of Democracy; Strength: Mild) shall be struck out and rendered null and void.

Argument: The United Nations,

AFFIRMING that due to different circumstances different criminals may warrant different sentences for the same crime and such each case should be judged individually, and;

COMMENDING UN#180 in its attempts to encourage member states to provide oversight to their judicial systems to examine trial and sentencing practices, however;

CONCERNED that the second article gives nations the license to use capital punishment too freely;

CONCERNED that individual states may use capital punishment for ANY offense they so choose including, but not limited to shoplifting, illegal drug possession, trespassing, and adultery;

BELIEVING that an internationally recognized standard practice regarding the use of capital punishment is in every member nation?s best interest in order to keep the peace;

HEREBY repeals UN #180, ?Fair Sentencing Act?

For right now, I'm against. I'm sort of on the fence here, but I know I was for the original resolution.

EDIT: After reading the rest of this, I'm leaning towards FOR.

FSA is a necessary buffer against unnecessary interference with nations' systems of justice, and is the most agreeable way to effect accountability in sentencing. And despite a moderator ruling to the contrary, I'm simply not convinced the fourth clause down is a valid argument.

Were my IDU puppet in the UN, I'd vote AGAINST.

And doesn't the Fair Sentencing Act contain what has been called a "blocker" provision?

Fris ruled it legal; HotRod has no more authority over the legality of proposals than I do.

Yes, FSA is intended as a blocker against ban on the death penalty. Remove it and witness the feeding frenzy on the General Assembly floor between those who would ban the death penalty and those who would rather rot than see such a thing pass. Me? I'd much rather return to the bad old days of never-ending abortion flamefights. Rolleyes

Rather rot than see a death penalty ban pass? Why? See, this is where I fail to follow the thought processes of pro DP advocates. Is it so crucial to have the "right" to kill prisoners that people would rather "rot" than be denied that "right"? Amazing.
