Description: UN Resolution #38: The Rights of Labor Unions (Category: Social Justice; Strength: Strong) shall be struck out and rendered null and void.

Argument: RECOGNISES that many member nations prefer the presence of Labor Unions in their economy.

NOTES that the abolition of all national labor unions would be extremely disastrous to the local economic atmosphere.

NOTES that Resolution #38, "The Right of Labor Unions", has serious flaws for the following reasons:

1) Does not allow the government to limit the scope of unions in areas vital to the well being of the nation, such as the military.

2) Does not give non-unionized workers protection against union discrimination.

3) Enables unions to appoint, rather than elect, their leaders, rig votes, or perform other such acts harmful to the workers

4) Allows wildcat strikes, secondary picketing and Union action outside of the rule of law

THEREFORE it is recommended that the each member nation decide on their own legislation concerning the implementation of unions.

The repeal is trumped up:

"2) Does not give non-unionized workers protection against union discrimination."

Who cares. The original resolution isn't supposed to do anything more than allow workers the right to unionize. The original resolution doesn't prevent the spread of infectious dieases either, but that isn't a reason against it either.

For now, my government is voting against this repeal.

AGAINST / NAY.

On might argue that unions are necessary or a necessary evil, but the fact remains that like Adam Smith's invisible hand, they will appear.

In my city, as in virtually all major North American cities, the police are unionised even though the name is "Police Association."

This is a civil right guaranteed by other UN resolutions. And protection does not include protection from mandatory dues payments (a.k.a. the Rand formula).

And neither does any pro-business resolution require them to be fair in their dealings. So?

Wildcat strikes are by definition illegal. So this means "illegal strikes are illegal," a classic illustration of tautology. It is precisely because of the propensity for workers to go on strike, legal or not, that unions are important. If strikes are to occur, they should occur under predictable and safe conditions for all. Strikebreaking and unionbusting do not end labour unrest, they just feed it.

Secondary picketing is freedom of speech.

Union action outside of the rule of law is already illegal, see tautology above.

The Nordic Republic votes AYE, simply because we don't want to have to dispatch mediators, as discussed in the original resolution, and because we feel there are many times when unions should not exist.
