Truth & Reconciliation Commission
#1

This will be starting soon. We will just RP in real-time and then when the RP is finished, we'll go back and say "this happened on X date" etc - the reason for this is we're all a little busy, and the holiday period is coming up, so we can't all commit to posting what I imagine will be quite lengthy pieces on X day at X time, and expect nations to respond (again with quite possibly lengthy pieces) before that day is out.

It'll be done in 2 phases.

First, we will address crimes done in the war. Secondly, we will discuss reparations.

In the first phase, the judge will call on each country (or in the case of Lauchenoiria, the interim-government) to present before her each grievance they have against specific persons or people. The judge will do this one at a time. So, for example, when the judge calls on the interim-gov, they might say Charissa Clarke, the Chaher family, reps of Gonhog govt, reps of Kerlile govt etc etc.

Once all the grievances are done, the judge will then collate them (for where a person/entity has been accused of a grievance by more than one country), and will assign a running order of when they will be heard. Then per case, she will hear prosecutory arguments, and then defence arguments.

For the sake of ease, there'll be no jumping in and rebuttal statements allowed. Think of it as the opening and closing prosecution and defence arguments rolled into one.

In the second phase, we'll do the same, but instead will be applications for reparations (i.e. costs etc) - so the interim government of Lauchenoria might say Conternias owes them X amount for y. Again, judge will hear arguments in favour, and then arguments not in favour.

After those two phases are done, the judge will pronounce her verdicts.

Any questions?

If the case of one individual leads to allegations against another who was not previously on the list, what would happen?

Just don't do that. When your country is called to give your list, give your list.

We're all stuck for time here, let's not make this harder than it has to be.

See, I see that happening a lot. Especially regarding the Kerlilians, who have 0 transparency.

Well if it happens, I'm not participating. Sorry. Can we just have this straightforward and get it over and done with?

That would be preferable. I am just saying I doubt it will happen.

Straightforward, understood.

Regarding the Kivasekian trio, it was one guy who gave the order to fire on civilians and another pair who followed it. Should I just list the guy who gave the order or all three?

All 3 would be somewhat similar to what happened in Nuremberg.

For these initial submissions, all I'm looking for is something like:

"The Provisional Government of Lauchenoiria would like judgement cast against The Queen of Sudan for orchestrating the bombings of Butterly and Larva City", or something like that.

Once all submissions have been collected, I'll group them into "cases" where there are commonalities, e.g., Laeral, Lauchenoriria, and whoever else might want to sue Conternia for the bombing of whatever city it was, or whatever. Then that'll be Case A.

If there are multiple submissions, please do them all in one post so.

"Firstly, the Provisional Government of Lauchenoiria would like judgement cast against The Queen of Sudan for orchestrating the bombings of Butterly and Larva City. Secondly, the same party would like judgement cast against The Lord of the Flies for stealing buttons off deceased. Thirdly etc etc etc"

Any questions, ask here. If people want to make a submissions, please post here also so I don't forget to call upon you.

I have several things on which I'd like clarification.

1. Should I list both the individuals, and the states we have grievances against? For example, we wish to seek reparations from Conternia for the Melissa City bombings but also want judgement against Ezra Griffiths for ordering them. So do I list both separately?

2. There are numerous nameless Kerlians who tortured people. Chances are none of their victims know their names. Have we to assume they're just going to get away with it?

3. I take it the individual who is to stand up and list our accusations is meant to be a lawyer appointed by the provisional government for this purpose?

Also I will want Kerlile called at some point. They're not happy about having to play ball, but that doesn't mean they won't take advantage of the situation to accuse their enemies.

1. Yes.

2. Well if you can't identify the person then yeah, they're going to get away with that. That's common sense, I would have thought? You can accuse Kerlile for orchestrating it if you don't have the names/identities of the individuals, but have evidence they were Kerlians.

3. An advocate, yeah.

Obviously, I am accusing Chevrox of conspiring to incite revolution. We are going under the platform that she was working with her government as posed to a lone wolf.

You recklessly endangered Kerlian lives in Carville as well as Lauchenoirian lives. Including their medical personnel.

For the avoidance of doubt, and perhaps I didn’t phrase it properly in discord because I’m a bit stressed and wasn’t thinking clearly, the question of “where is Jonas Kelley” is an out-of-character question because I have yet to reach an agreement with another person as to whose nation he is in.

In character, I assume the governments of Lauchenoiria and Laeral are aware of his location and were before they filed a grievance against him. So it shouldn’t be a problem from an in-character perspective.

Jonas Kelley can be in Gonhog. Probably taking residence in a neutral embassy, possibly Shuell.

Otherwise, I have no grievances. Any that have happened have no evidence behind them.

OOC: Jonas Kelley could have fled to Zamastan. I could be misinterpreting everything I'm reading so feel free to decline if it's not the path y'all want to take. There's a city in Zamastan called Tirzah which is home to several mega-wealthy individuals (modeled after Beverly Hills or North Vancouver neighborhoods). It would be an area Kelley (if he is super wealthy) would feel safe living/hiding away. Zamastan has not been involved in the whole diplomacy aspect of the civil war and its ramifications, so our authorities won't be looking for him, which also makes it a good spot for him to be. If, however, he were to be in our nation, President Anya Bishop could arrange for an international warrant to be issued for his arrest and capture.

This is the link to the city in question: https://www.theidu.us/wiki/Tirzah

Kelly pulling a Julian Assange would be pretty cool. We could make a whole deal out of orchestrating his capture, working with Shuell, (if it was their embassy) to kick him out, etc.

Let's not make things needlessly complicated. When asked to extradite, do so, please. I really don't want us to still be doing this in 2020, if that's ok?

I’d rather get this over with ASAP, so just say the word and I’ll extradite him
