Repeal "The Right to a Fair Trial"

Repeal
Resoulution 3
The Dourian Embassy

Description: WA Resolution #3: The Right to a Fair Trial (Category: Human Rights; Strength: Strong) shall be struck out and rendered null and void.

Argument: Understanding that the intended purpose of "The Right to a Fair Trial" is to provide fair trials,

Noting that the resolution fails to understand that the WA is composed of wildly divergent cultures in its description of a "Fair Trial",

Also noting that the resolution fails to take into account that certain nations have long-established non-jury judicial systems of unquestioned integrity,

Regretting that the resolution allows defendants to choose any person to represent them, despite the legal ramifications of possible conflicts of interest,

Further regretting that the resolution allows defendants any number of appeals they wish,

Noting that this flawed legislation bars a more effective resolution from passage,

Seeking the opportunity to introduce a more effective version of this resolution to the World Assembly,

The World Assembly hereby repeals "The Right to a Fair Trial".

How should we vote?

The resolution is now at vote.

Pro. I never did like the original.

This resolution seems to have the most blatant call to the National Sovereignists I've ever seen in a repeal.

I'm tempted to oppose just for that, but INDECIDED for now.
#5

I shall abstain

As stated in the "Support" thread, the government of Jagera opposed the original (and its alternative; they were both flawed). Therefore, we stand in favour of this repeal.

Frontenax votes PRO...

The right to any number of appeals is absolutely killing the Ministry of Justice.

I abstained.

I completely agree. I didn't care for the original because it did sort of read too heavily into the finer details of life, but I also generally do not like repeals.

Parts of this repeal are very well written ... I'm not going to vote against it. But I also don't know if I completely agree with the statement, "Further regretting that the resolution allows defendants any number of appeals they wish,". I don't think this is untrue, but I also am undecided if this is consistent with my view.

I do feel there is a strong point I'll toss out as a possible reason to vote in favour:

"Seeking the opportunity to introduce a more effective version of this resolution to the World Assembly,"

Overall DE did a great job with the repeal and isn't closing the door.

A replacement resolution has been proposed and is currently being discussed. Those interested should certainly get involved:

Results tallied, vote cast PRO.

For what it is worth, Mikitivity has changed its vote in favour.

This has nothing to do with any "gifts" being sent to my government from nations in favour of the resolution. Nothing at all. Wink
