Misfeasance, Malfeasance & Nonfeasance

It troubles me to have to bring up the feasances, but it appears to be a topic whose time has come.

Miki (and to others who would like to chime in), does the IDU have any provisions for the removal of a UN Delegate who has not performed their duty? I've combed the archives (a bit) and have not located anything that appears appropriate.

I wish it hadn't come to this, but it appears as though our Vice-Delegate is neglecting the duties of serving as Acting Delegate. As such, the IDU is going unrepresented. If I am mistaken, I apologize and by all means encourage the Vice Delegate to become active.

However, if this nonfeasance is in fact occuring, the situation should not be tolerated. Therefore, I feel I must raise the question of whether or not mechanisms have been put in place to address this sort of situation. If they have not been - we're probably stuck (although we're in a place where we can call an election shortly). If they are, it may be time to explore them.

Any thoughts or advice are appreciated.

Legally speaking I'll have to double check, but with the growing inactivity of Scoopy (whom I've telegrammed and messaged both via NationStates and Invision), I think this is legally what we must do:

1) Accept the results of the previous election and endorse Groot Gouda and Scoopy alike ...

2) Just prepare for having to call the election commission into action if Scoopy expires prior to when Groot Gouda returns.

However, given that Groot Gouda did appoint my government as the acting-Vice Delegate under Scoopy, I can start telegramming all IDU members asking that they endorse my government per Groot Gouda's request (and naturally I'll point to where the post was made public). Smile

The bad news, our votes won't be doubled in the UN and we can't endorse proposals. There is a good chance Scoopy, whom was active, is just on vacation, and will return in August as well. But 10 days is a long wait.

Squatters rights, no doubt. Smile Except for my government's annual inactivity in May/June, it is a safe bet that on most weeks that somebody from my government is around to keep a watchful eye on the region.

May I recommend that you arrange an endorsement campaign for Mik? He can always shed endorsements if and when Scoopy returns.

Here here! I joined at the end of the last election and thought it odd that Scoopy was inactive just after trying to become the Delegate. My sporadic presence is precisely why I wouldn't run.

In Scoopy's case I seem to remember a pledge to be more involved at the end of the election, which has sadly gone unfulfilled. Are we to have empty election promises here as well?

Miki, I'm removing my endorsement from Scoopy and I think I've already endorsed you so if a few others do this we should be in business.

Gouda's now your delegate - he and Scoopy both have 26 endorsements. I think the nearest challengers are Sober Thought (22) and Keeslandia (21).

So, here I am, back again.

I feared Scoopy would not fullfill his duties, which is why I specifically mentioned that Mikitivity was allowed to do the Delegate Duties for me. Although there is no specific law for such cases, the very basic rule is "Trust the delegate to take the right decision". In this case, the provision that allowed Miki to legally take over. If I hadn't, the elections could have been held earlier or either an EC or Government member could have been appointed delegate. I think we should put into law those who have an official Government position, though currently that's only the Immigration Minister and the Vice Delegate. But I think it works fine now, after all, a delegate can *always* be removed from their position.

It was only two weeks I was away now, and I have to admit that I was so busy before my vacation that arranging delegate matters in my absence ended up too low on the list. I should have arranged matters at least a week beforehand.

But I'm back now, and won't leave my internet connection until after the elections Smile

Welcome back Groot Gouda. Yeah - none of this was "end of the world" kind of stuff. After asking this question, I just assumed the path of least resistance would be to go ahead and kick off the election campaign - which you can see we did. It's just unfortunate we had to ask the question.
