<br />
After some discussion with the Delegate's Council, we feel that it would be best to properly align the constitution and regional governance of the International Democratic Union to match better a region of (a) our size, and (b) our expertise, which is roleplay, nation-building, and cultural development.<br />
<br />
It's time, we feel, to abolish IDUSA and bring back something familiar from our past, CIDUS. CIDUS, the Council of IDU States, was an IC/RP body at a time when the IDU wasn't big into IC/RP. But now the IDU is ready for that kind of IC, UN-esque body that can better reflect intra-regional politics etc. This time, though, we'll give it a different name - the League of IDU Nations, or LIDUN.<br />
<br />
It's also time to separate Delegate from regional governance. There is no reason why the Delegate should also be the regional leader. It means people whose focus is on RP, are dragged into a mainly OOC role, or have to be members of the WA if they want to be the regional leader, when that might go against regional canon. Our proposals are that LIDUN elects a President who is the IC and OOC leader of the region, and then we have a Delegate whose job is to vote on WA proposals as per the region's wishes. <br />

§2 - Regional Governance<br />
<ol type="1" class="mycode_list"><li>All matters of regional governance not otherwise laid out by this Constitution is reserved to a regional body called the League of IDU Nations.<br />
</li>
<li>All IDU states are entitled to apply to join the League of IDU Nations. <br />
</li>
<li>The League of IDU Nations will be, except where determined otherwise by this Constitution or the body itself, considered an In-Character (IC) body, and may make laws for, and resolve differences within, the region.<br />
</li>
<li>The League of IDU Nations will operate on a one player, one vote basis for all Out of Character (OOC) matters including elections. The League of IDU Nations may regulate membership and voting rights for all IC matters.<br />
</li>
<li>The League of IDU Nations will elect a member nation to be President of the body for a term of office not exceeding one (1) year in length. This term length may be shortened by the body itself, should it so choose to do so.<br />
</li>
<li>The President of the League of IDU Nations will act as the OOC head of state and government of the region for the length of their tenure. The player whose nation is selected as President will be responsible for all OOC foreign and domestic policy of the region, save for regional security and World Assembly matters which are the sole responsibilities of Regional Founder(s), and the World Assembly Delegate respectively.<br />
</li>
<li>The player of the nation elected as President of the League of IDU Nations will also act as the IC leader of the League of IDU Nations. Powers related to the IC role of President will be regulated by the League of IDU Nations. <br />
</li>
<li>No player may be elected to the position of President of the League of IDU Nations for more than two consecutive terms.<br />
</li>
<li>The President of the League of IDU Nations may be elected to office, and removed from office prematurely, in a manner to be decided by the League of IDU Nations.<br />
</li>
<li>The President of the League of IDU Nations may delegate some duties of OOC governance to other nations/players, but they too must be members of the League of IDU Nations for the duration of such delegation.<br />
</li>
<li>The President of the League of IDU Nations may also delegate some IC duties to other member nations of the League of IDU Nations. Such duties which may be delegated shall be determined by the League of IDU Nations.<br />
</li>
</ol>
§3 - World Assembly Delegate<br />
<ol type="1" class="mycode_list"><li>A nation may be selected by the League of IDU Nations to be the region’s World Assembly Delegate. It is not required for the nation to be a member nation of the League of IDU Nations, but they are required to be, and to remain, members of the World Assembly.<br />
</li>
<li>The nation selected as World Assembly Delegate shall enjoy a tenure in office with no defined limit.<br />
</li>
<li>The World Assembly Delegate shall leave office via retirement, ending their membership of the World Assembly, ceasing-to-exist, or impeachment by the League of IDU Nations. The League of IDU Nations shall make their own provision on reasons for impeachment, and the manner, vote threshold, and other such provisions that an impeachment vote should take.<br />
</li>
<li>Except for required formalities in the League of IDU Nations where necessary, the World Assembly Delegate shall be an otherwise OOC position.<br />
</li>
<li>The World Assembly Delegate may require nations not to exceed a certain number of endorsements. The World Assembly Delegate may request the Regional Founder(s), with agreement from the President of the League of IDU Nations, eject nations that threaten to unseat the World Assembly Delegate via endorsement count.<br />
</li>
<li>The World Assembly Delegate position should remain a non-executive position in the context of regional security and controls.<br />
</li>
<li>The World Assembly Delegate is required to vote in the General Assembly, Security Council, or any other World Assembly body in a manner that reflects the region’s wishes. The World Assembly Delegate is required to post on the Regional Message Board at the time of their vote, and the manner of how they voted. The World Assembly Delegate may, from time to time, abstain from voting if they are of the belief the region is equally, or close to equally, divided.<br />
</li>
<li>Notwithstanding the above provision, the World Assembly Delegate may vote on behalf of the region in the General Assembly, Security Council, or any other World Assembly body, according to their own beliefs and their own position provided that their vote at close of voting ultimately reflects the will of the region.<br />

<li>The World Assembly Delegate shall have discretion to approve proposals made to the General Assembly, Security Council, or any other World Assembly body.<br />

Judges should have a calm demeanor, as well as being active participants in regional affairs and Roleplay and must also have the ability to fairly see both sides of an argument. <br />
<br />
3. Each Judge, if appointed, shall have a seat for two years, unless they either cease to exist in NS and the IDU forums, resign, or are Impeached. <br />
<br />
4. If a Judge ceases to exist, but reappears within two weeks, they shall retain their position.<br />
<br />
4A. Defines ceasing to exist as disappearing from forum and/or discord activity for an extended amount of time without explanation. If someone disappears with an explanation, it shall not be considered ceasing to exist.<br />
<br />
5. In the event that a Judge breaks IDU laws or abuses their power, they may be impeached.<br />

5A. To hold an impeachment trial, a motion of impeachment will be brought before the Delegate, who decides if it has merit. If approved, a trial takes place.<br />

1. To uphold the law of the IDU, the Committee may hold a trial if the IDUSA has voted to accuse a nation of breaking one of said laws. The Speaker, or a Proxy, would serve as the prosecutor, with the Defendant either representing themselves or having a Proxy represent them. <br />
<br />
1A. After the closing arguments of both the prosecution and defense, the judges will adjourn to discuss and to come up with a verdict, which is reached with a vote between the Judges. <br />
<br />
1B. The  IDUSA is obligated to come up with Penalties for breaking IDU regulations for the Judges to uphold.<br />
<br />
2. If a Judge faces a conflict of interest that would interfere with their duty to fairly judge a trial, they have a duty to relinquish themselves from that case.<br />
<br />
3. If a tie occurs, which could only happen if a Judge relinquishes themselves from a case, it falls to the remaining Judges to come up with a unanimous decision.<br />
<br />
4. As stated in the Charter, additional Trial Procedure shall be regulated by the Judicial Committee.<br />

<br />
1.All Parties involved in a trial are expected to politely listen to everyone, especially the judges. Any attempts to protest out of turn, outside of an objection, will result in a warning.<br />

2. While participating in a trial, everyone is also expected to exhibit proper trial behavior.<br />
<br />
2A. Defines proper trial behavior as refraining from swearing or making obscene or threatening comments, while respecting all other trial participants.<br />

3. If a participant has broken proper behavior once, been told to stop by a judge, and has continued to be disrespectful, a judge may hold that participant in contempt, resulting in a minor punishment.<br />

This IDU States Assembly,<br />
<br />
<span style="font-weight: bold;" class="mycode_b">Grateful</span> that the members of The International Democratic Union (hereinafter “IDU”) who have the ability to eject/ban other members of the IDU are some of most well respected and upstanding members of the community.<br />
<br />
<span style="font-weight: bold;" class="mycode_b">Believing</span> that it directly counters the founding principles of this region that said members would posses the unchecked ability to eject any member of the IDU for any reason deemed arbitrarily to be a "security threat." <br />
<br />
<span style="font-weight: bold;" class="mycode_b">Noting</span> that there is no regional definition of what a security threat is or looks like and therefore the members of The IDU with Founder privileges may and must interpret "security threats" as they see fit. <br />
<br />
<span style="font-weight: bold;" class="mycode_b">Acknowledging that</span>, although unlikely, a regional raid is a distinct possibility and a severe threat to the IDU as a region. As such, it would be unwise to prohibit founder privilege nations to use their executive function in times of actual time-sensitive crisis.<br />
<br />
With that said, hereby resolves the following<br />
<br />
§1 <span style="text-decoration: underline;" class="mycode_u">Ejection Protocol</span><br />
<br />
1. Defines Executive Powers as the ability to eject/ban users from the region and suppress the posts of another user<br />
<br />
2. Defines "Founder Privileges" as the individual users who have access to the Founder Nation, "The IDU"<br />
<br />
  3.  All members of the IDU with Executive Powers must do the following in the event that they see fit to eject a member for breaching regional policy:<br />
<br />
a. Formally declare their target and rationale for ejection on The IDU's Regional Message Board<br />
<br />
b. Contact another member of the IDU who holds Executive Powers and gain their explicit consent to eject the member. This consent should be expressed publicly on the RMB or other public method such as the IDU official discord chat.<br />
<br />
4. In the event that a user with founder privileges uses the founder nation to nominate a user for ejection, they must disclose which user they are.<br />
<br />
5. In the event that two or more nations with Executive Powers agree to the ejection of the target, herein referred to as "the defendant,” this assembly shall grant the defendant these following rights:<br />
<br />
a. A minimum of 24 hours to voluntarily leave the region<br />
<br />
b. A chance on to defend their actions or statements on a public chat such as the RMB or a specifically designated appeals channel/forum on either the IDU Forums or Discord.<br />
<br />
c. All nations with Executive Powers should take the merits of the defendant's argument into account and, should they prove valid, reverse their decision to eject.<br />
<br />
§2 <span style="text-decoration: underline;" class="mycode_u">Ejections of Regional Officials</span><br />
 <br />
1. Defines "Elected Official" as a user who's nation holds an regional role that they were elected to<br />
<br />
2. No Elected Official may be ejected or removed from position without an IDU Judiciary Committee hearing. In the event they are found to have breached regional policy, the defendant may be removed from office or ejected from the region by any user with eject/ban capabilities at the Committee’s discretion. <br />
<br />
§3 <span style="text-decoration: underline;" class="mycode_u">Raid/Raiding Provision</span><br />
<br />
1. Herby defines the following,<br />
<br />
a. A “Raid” as: The event in which a group of non-region native nations/users rapidly join the region with the intent of quickly electing a member of their group to the position of delegate via endorsements and harming the IDU. <br />
<br />
b. A “Raider” as: Any user or nation taking part in the raid<br />
<br />
2. In the event of a raid from an outside entity, it is the duty of those individuals granted Executive Powers to use every ability at their disposal to avert a crisis. In the event of a raid:<br />
<br />
a. Article I of this bill is suspended for the duration of the raid<br />
<br />
b. Any and all nations with executive powers have the right to eject, ban, and suppress the Message Board post(s) of any members they deem to be part of the raid<br />
<br />
c. If a non-democratically instated Delegate should take power, they are exempt from Article II and may be banned/ejected.<br />
<br />
c. After the invariable conclusion of the raid, when all raiders have been ejected or have left, Article I shall take effect again <br />
<br />
§4 <span style="text-decoration: underline;" class="mycode_u">Other Provisions and Exemptions</span><br />
<br />
  1. Users with Executive Powers may eject any member from the region during the Z-day Event for breaching the Anti-Zombie Policy so long as the following requirements are fulfilled:  <br />
<br />
a. Members of the region have been reminded of the Anti-Zombie Policy by messages on the Regional Message Board and given ample opportunity to correct of their actions<br />
<br />
  b. Is not the delegate  <br />
<br />
2. Upon the conclusion of Z-Day Event. The user in question shall be unbanned (if applicable) and formally invited to rejoin the region with all due cordiality.</blockquote>

<div style="text-align: center;" class="mycode_align">A bylaw to regulate the use of Executive Powers in The International Democratic Union</div>
<br />
This IDU States Assembly,<br />
<br />
<span style="font-weight: bold;" class="mycode_b">Grateful</span> that the members of The International Democratic Union (hereinafter “IDU”) who have the ability to eject/ban other members of the IDU are some of most well respected and upstanding members of the community.<br />
<br />
<span style="font-weight: bold;" class="mycode_b">Believing</span> that it directly counters the founding principles of this region that said members would posses the unchecked ability to eject any member of the IDU for any reason deemed arbitrarily to be a "security threat." <br />
<br />
<span style="font-weight: bold;" class="mycode_b">Noting</span> that there is no regional definition of what a security threat is or looks like and therefore the members of The IDU with Founder privileges may and must interpret "security threats" as they see fit. <br />
<br />
<span style="font-weight: bold;" class="mycode_b">Acknowledging that</span>, although unlikely, a regional raid is a distinct possibility and a severe threat to the IDU as a region. As such, it would be unwise to prohibit founder privilege nations to use their executive function in times of actual time-sensitive crisis.<br />
<br />
With that said, hereby resolves the following<br />
<br />
§1 <span style="text-decoration: underline;" class="mycode_u">Ejection Protocol</span><br />
<br />
1. Defines Executive Powers as the ability to eject/ban users from the region and suppress the posts of another user<br />
<br />
2. Defines "Founder Privileges" as the individual users who have access to the Founder Nation, "The IDU"<br />
<br />
  3.  All members of the IDU with Executive Powers must do the following in the event that they see fit to eject a member for breaching regional policy:<br />
<br />
a. Formally declare their target and rationale for ejection on The IDU's Regional Message Board<br />
<br />
b. Contact another member of the IDU who holds Executive Powers and gain their explicit consent to eject the member. This consent should be expressed publicly on the RMB or other public method such as the IDU official discord chat.<br />
<br />
4. In the event that a user with founder privileges uses the founder nation to nominate a user for ejection, they must disclose which user they are.<br />
<br />
5. In the event that two or more nations with Executive Powers agree to the ejection of the target, herein referred to as "the defendant,” this assembly shall grant the defendant these following rights:<br />
<br />
a. A minimum of 24 hours to voluntarily leave the region<br />
<br />
b. A chance on to defend their actions or statements on a public chat such as the RMB or a specifically designated appeals channel/forum on either the IDU Forums or Discord.<br />
<br />
c. All nations with Executive Powers should take the merits of the defendant's argument into account and, should they prove valid, reverse their decision to eject.<br />
<br />
§2 <span style="text-decoration: underline;" class="mycode_u">Ejections of Regional Officials</span><br />
 <br />
1. Defines "Elected Official" as a user who's nation holds an regional role that they were elected to<br />
<br />
2. No Elected Official may be ejected or removed from position without an IDU Judiciary Committee hearing. In the event they are found to have breached regional policy, the defendant may be removed from office or ejected from the region by any user with eject/ban capabilities at the Committee’s discretion. <br />
<br />
§3 <span style="text-decoration: underline;" class="mycode_u">Raid/Raiding Provision</span><br />
<br />
1. Herby defines the following,<br />
<br />
a. A “Raid” as: The event in which a group of non-region native nations/users rapidly join the region with the intent of quickly electing a member of their group to the position of delegate via endorsements and harming the IDU. <br />
<br />
b. A “Raider” as: Any user or nation taking part in the raid<br />
<br />
2. In the event of a raid from an outside entity, it is the duty of those individuals granted Executive Powers to use every ability at their disposal to avert a crisis. In the event of a raid:<br />
<br />
a. Article I of this bill is suspended for the duration of the raid<br />
<br />
b. Any and all nations with executive powers have the right to eject, ban, and suppress the Message Board post(s) of any members they deem to be part of the raid<br />
<br />
c. If a non-democratically instated Delegate should take power, they are exempt from Article II and may be banned/ejected.<br />
<br />
c. After the invariable conclusion of the raid, when all raiders have been ejected or have left, Article I shall take effect again <br />
<br />
§4 <span style="text-decoration: underline;" class="mycode_u">Other Provisions and Exemptions</span><br />
<br />
  1. Users with Executive Powers may eject any member from the region during the Z-day Event for breaching the Anti-Zombie Policy so long as the following requirements are fulfilled:  <br />
<br />
a. Members of the region have been reminded of the Anti-Zombie Policy by messages on the Regional Message Board and given ample opportunity to correct of their actions<br />
<br />
  b. Is not the delegate  <br />
<br />
2. Upon the conclusion of Z-Day Event. The user in question shall be unbanned (if applicable) and formally invited to rejoin the region with all due cordiality.</blockquote>
